Our store is hosted by Shopify, which provides the ecommerce platform through which we offer our products.
You may use this website only for lawful purposes. You must not use it:

Products purchased through this website are intended for personal use unless otherwise agreed in writing. Wholesale, resale or commercial orders require our prior approval.
4. Product Information
We take reasonable care to describe and present our products accurately. However, colours and finishes may appear differently depending on the screen, device or display settings used.
Francis de Lara pieces frequently incorporate natural gemstones and individually finished materials. Variations in colour, pattern, texture, transparency, inclusions and surface character are natural and form part of the individuality of each piece. These characteristics are not ordinarily considered defects.
Measurements, weights and dimensions are approximate unless expressly stated otherwise.
Product photographs are illustrative. Where a product contains natural materials or is individually hand-finished, the piece supplied may not be identical in every detail to the item photographed.
5. Eyewear and Prescription Lenses
Unless expressly stated otherwise, eyewear sold through the website is supplied with the lenses described on the relevant product page.
Customers requiring prescription or customised lenses are responsible for supplying accurate and current prescription information to the qualified optical professional completing the work.
Prescription lenses should be fitted and checked by a suitably qualified optician. Francis de Lara is not responsible for work performed, lenses supplied or alterations made by an independent optician or other third party.
Alteration, glazing, repair or adjustment by a third party may affect your ability to return an item where the product has been changed from its original condition. This does not affect your statutory rights where the original product was faulty.
6. Availability and Limited Editions
All products are subject to availability.
Many Francis de Lara pieces are produced in limited quantities. Placing an item in your basket does not reserve it. A product may become unavailable before checkout is completed.
We may limit the number of pieces available to an individual customer, household, delivery address or order where reasonably necessary to preserve limited availability, prevent unauthorised resale or address suspected fraud.
If an item becomes unavailable after you place an order, we will notify you and refund any payment taken for that item.
Descriptions such as “limited edition”, “one of one” or references to production quantities apply as stated on the relevant product page. We may continue an established design in a different gemstone, lens colour, engraving, texture, material or finish without that constituting a reproduction of the same edition.
7. Placing an Order
When you place an order, you are making an offer to purchase the selected products under these Terms.
After receiving your order, we will send an automatic acknowledgement. This confirms that we have received your order; it does not necessarily mean that we have accepted it.
A binding contract is formed when we send you a dispatch confirmation or otherwise expressly confirm that we have accepted your order.
We reserve the right to decline or cancel an order before acceptance, including where:

Payment cannot be authorised

Information supplied appears incomplete or inaccurate

We identify an error in the product description or price

We reasonably suspect fraud, misuse or unauthorised resale

We cannot deliver to the address provided

Legal or regulatory restrictions prevent us from fulfilling the order
If payment has already been taken for an order we cannot accept, we will refund the relevant amount.
8. Bespoke, Made-to-Order and Personalised Pieces
Bespoke, made-to-order and personalised products may be subject to separate specifications, prices, payment schedules and estimated completion dates.
You are responsible for checking and approving all relevant specifications before production begins, including dimensions, gemstone selection, engraving, prescription information and other requested details.
Natural gemstones may vary from samples, reference photographs or previous pieces.
Once work has begun, changes may not be possible or may incur additional costs. We will discuss any material change with you before proceeding.
The statutory change-of-mind cancellation right does not normally apply to goods made to your specifications or clearly personalised, including bespoke commissions, custom gemstone pieces, engraving and prescription or customised lenses.
This exclusion does not affect your rights if an item is faulty, damaged, incorrect or not as described.
9. Prices and Payment
Prices are displayed in the currency selected or shown on the website. The price payable is the price presented at checkout when the order is submitted.
UK prices include VAT where applicable. The price shown to customers outside the UK may not necessarily be reduced by the amount of UK VAT. Any tax treatment applied to an order will be reflected at checkout.
Delivery charges, where applicable, are shown separately before you complete your order.
International orders may be subject to customs duties, import taxes and local charges. Unless expressly stated at checkout, these are not included in the product price or delivery charge and are the recipient’s responsibility.
We accept the payment methods displayed at checkout. Payment must be authorised before an order can be processed.
You confirm that you are authorised to use the payment method supplied and that the associated billing information is accurate.
10. Pricing and Website Errors
We make reasonable efforts to ensure that prices and product information are accurate. Errors may occasionally occur.
If we discover an obvious pricing or product-information error before accepting your order, we will contact you and give you the option to proceed using the correct information or cancel the order for a full refund.
We are not obliged to supply a product at an obviously incorrect price where the error could reasonably have been recognised as a mistake.
11. Shipping and Delivery
Orders are processed and delivered in accordance with our Shipping Policy, which forms part of these Terms.
Delivery dates and timeframes are estimates unless expressly confirmed as guaranteed.
Goods remain our responsibility until they are delivered into your physical possession or to a person identified by you to receive them. If you nominate a safe place or authorise delivery to a particular location, delivery to that authorised location may constitute delivery to you.
International customers are responsible for complying with applicable import requirements and providing information requested by customs authorities or delivery providers.
Nothing in these Terms limits any statutory right you may have where goods are not delivered within an agreed or legally required period.
12. Cancellations, Returns and Refunds
Cancellations, returns and refunds are governed by our Refund & Returns Policy, which forms part of these Terms.
UK customers purchasing online generally have the right to cancel an eligible order before delivery or within 14 days beginning the day after receipt. After notifying us, the customer normally has a further 14 days to return the item.
Exceptions may apply to goods made to the customer’s specifications or clearly personalised.
These change-of-mind provisions are separate from your statutory rights concerning faulty, damaged, incorrect or misdescribed goods.
13. Faulty or Damaged Products
We are legally responsible for supplying goods that are as described, of satisfactory quality and fit for purpose where a particular purpose has been made known to us.
If you believe an item is faulty, damaged, incorrect or not as described, please contact info@francisdelara.com as soon as reasonably possible with your order number and supporting photographs where appropriate.
Depending on the circumstances and your applicable legal rights, we may arrange a repair, replacement, price reduction or refund.
Nothing in these Terms excludes or restricts your statutory consumer rights.
14. Care, Wear and Repairs
Francis de Lara products should be handled, stored and maintained with appropriate care.
Damage resulting from accidental impact, misuse, improper storage, unauthorised alteration, inappropriate cleaning, normal wear and tear or failure to follow supplied care instructions is not ordinarily considered a manufacturing fault.
Gemstones, plating, lenses, screws, hinges and other components may show wear over time according to use and handling.
Where possible, we may offer an assessment or repair service. Repairs outside your statutory rights may be subject to availability, assessment, charges and shipping costs. We will provide details before undertaking chargeable work.
15. Intellectual Property
All intellectual-property rights in this website and its contents belong to Francis de Lara, JP Creative Emporium Ltd or the relevant licensors.

Nothing on the website grants you ownership of or a licence to use Francis de Lara intellectual property except as strictly necessary for personal use of the website.
16. Reviews, Comments and Submitted Material
If you submit a review, photograph, comment or other material to us, you confirm that:

Where such an event affects an accepted order, we will take reasonable steps to minimise the effect and will contact you where a material delay is expected.
Your statutory rights, including any right to cancel because delivery has not taken place within an agreed or legally required period, remain unaffected.

We may update these Terms from time to time to reflect changes to our business, website, services or legal obligations.
The Terms applicable to your order are those in force when you place it. Changes made afterwards will not retrospectively alter an existing contract unless required by law or agreed with you.

22. Severability
If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be treated as removed or limited to the minimum extent necessary. The remaining provisions will continue in effect.

The courts of England and Wales will have jurisdiction, without limiting any right a consumer may have to bring proceedings in another court permitted by applicable law.
